2. What information we collect

When you fill in our enquiry form

  • Contact details: your full name, mobile number and email address.
  • Details of your deal: what you need funding for, where the security property is, its approximate value and when you need the funds.
  • Your declaration: your confirmation that you have never been convicted of fraud or money laundering. We do not ask for, or record, any other details about criminal convictions.
  • Your preferences: whether you agreed to this notice, and whether you asked to receive marketing from us.
  • How you found us: the address of the page you submitted the form from, and any campaign tags in that address (for example, which advert you clicked).

When we speak with you

If you go on to discuss your case with us, we will collect further information needed to find suitable finance. This may include details of the property, your income, assets and liabilities, your borrowing history, your company and its directors, your identity documents, and your plans for repaying the loan. We will explain what we need at the time.

From other sources

With your agreement, we may receive information about you from lenders, valuers, solicitors and other professionals involved in your case, and from public sources such as Companies House and HM Land Registry.

3. How we use it, and our legal basis

Data protection law only lets us use your information where we have a lawful reason. Ours are set out below.

What we use it forOur lawful basis
Contacting you about your enquiry and giving you an initial view of your caseYour consent, given when you tick the box on our form
Finding, arranging and managing finance for you once you ask us to proceedTaking steps at your request before entering a contract, and then performing our contract with you
Identity checks, anti-money laundering and fraud prevention checks, and keeping the records the FCA requiresLegal obligation
Confirming you have no conviction for fraud or money launderingPreventing or detecting unlawful acts and meeting regulatory requirements, as permitted by the Data Protection Act 2018
Handling complaints and defending legal claimsLegal obligation and our legitimate interests
Sending you details of our services and productsYour consent, only if you ticked the marketing box

We will not use the details you give us on the enquiry form to market to you unless you tick the separate marketing box.

Our form automatically tells you if your case falls outside what we can arrange, for example where the security is outside mainland UK or worth less than £250,000. This is a simple eligibility check. We do not make any decisions about you that have a legal or similarly significant effect based solely on automated processing.

4. Who we share it with

We never sell your personal information or pass it to lead buyers. We only share it where we need to, with:

  • Lenders and their agents, when you ask us to approach them on your behalf. Lenders will use your information under their own privacy notices, which may include credit and fraud prevention checks.
  • Other professionals involved in your case, such as valuers, surveyors and solicitors.
  • Our service providers, such as our customer relationship management system, email, telephone and IT providers, who process information only on our instructions.
  • Regulators and authorities, such as the Financial Conduct Authority, the Financial Ombudsman Service, HM Revenue & Customs or law enforcement, where the law requires it.

5. Transfers outside the UK

Some of our service providers store data outside the UK, including in the United States. Where this happens, we make sure your information is protected by an approved safeguard, such as a UK adequacy decision, the UK Extension to the EU-US Data Privacy Framework, or the UK International Data Transfer Agreement.

6. Cookies

Our website does not currently set advertising or analytics cookies. If that changes, we will update this notice and ask for your consent before any non-essential cookies are used.

7. How we keep it secure

We use appropriate technical and organisational measures to protect your information, including encrypted connections, access controls and working only with providers who meet recognised security standards. Only people who need your information to deal with your case can see it.

8. How long we keep it

  • If you do not go ahead: we keep your enquiry for up to 2 years from our last contact, so we can pick it up again if you return, and then delete it.
  • If we arrange finance for you: we keep your records for at least 5 years after our relationship ends, as anti-money laundering rules and FCA record-keeping rules require, and longer where needed to deal with a complaint or legal claim.
  • Marketing preferences: until you withdraw your consent. We keep a record that you opted out so we do not contact you again.

9. Your rights

You have the right to:

  • ask for a copy of the personal information we hold about you;
  • ask us to correct anything that is wrong or incomplete;
  • ask us to delete your information, where we no longer need to keep it;
  • ask us to restrict how we use it, or object to us using it;
  • ask us to send your information to another organisation, where this applies;
  • withdraw your consent at any time, including to marketing. This does not affect anything we did before you withdrew it.

To use any of these rights, contact us using the details in section 1. You do not have to put your request in writing. We will respond within one month and will not usually charge a fee.

You can stop marketing at any time by replying "stop" to any message, using the unsubscribe link in any email, or telling us by phone.

10. Complaints

If you are unhappy with how we have handled your information, please tell us first so we can put it right. You also have the right to complain to the Information Commissioner's Office (ICO), the UK regulator for data protection, at https://ico.org.uk/make-a-complaint/ or on 0303 123 1113.

Links to the ICO open in a new window. You are then leaving the website of Noble Life Ltd, and we cannot be held responsible for the content of external websites.
